The Approach of Originalism in Constitutional Interpretation and its Effects on the Procedure of the Guardian Council

Abstract

A precise, regular and also living constitutional interpretation being compatible with the goal and spirit of the Constitution is an essential issue which prevents conflicts of powers, difficulties and rapid constitutional changes. In this respect, there are various and of course, different approaches including the approach of originalism which is coined in half a century ago and is already among the most important theories regarding constitutional interpretation.
Noting the interpretive procedure of the Guardian Council implies that the  intent of constitution-makers and also jurisprudential (Islamic) criteria constitute the main pillars of constitutional interpretation. This study through a descriptive- analytical approach suggests that the interpretive procedure of the Guardian Council is in close consistent with the approach of originalism.
