Publication of Detailed Discussions of the Cabinet: Contexts, Ambiguities, and Criminal Liability

Abstract

According to Article 3 of the Transparency Law of the Three Branches of Government, approved on 10/2/1403, the Cabinet is required to publish the detailed minutes of its discussions, except for cases specified in this article, within one month on its information platform. Additionally, under Article 5 of this law, failure to execute or incomplete execution of this legal obligation, or the publication of information contrary to the provisions of the law, has been criminalized. Given the innovative nature of this legal requirement and the lack of experience of the Islamic Republic of Iran in publishing detailed minutes of its sessions, along with some ambiguities in Article 3 of the Transparency Law and the absence of the necessary administrative and operational frameworks, the implementation of the law faces several challenges. Ambiguities regarding the "definition of detailed minutes," "law enforcer," "timeframe for the implementation of the law," "authority and method for determining non-publishable discussions," "possibility of publishing filtered discussions at a later time," and "limits of criminal responsibility" are among the obstacles to the law's implementation. In this paper, by clarifying the theoretical and practical processes currently in place for drafting the government's detailed minutes and exploring the ambiguities of the Transparency Law, suggestions are presented to overcome the existing barriers and fully realize the intentions and objectives of the legislator, while avoiding criminal liability for the law enforcers.
