Administrative Justice: Conceptual Framework and Institutional Mechanisms

Abstract

One of The main concerns for public lawyers in all of the world is to assist in the development of mechanisms that be able to realize and infuse the broad and far-reaching expectations of justice into mechanisms of decision making and administrative action. This can only be realized through creating properly processes of participation (consultation and procedural fairness) and accountability and responsibility (mechanisms of redress and dispute resolution). It is through these processes of accountability and legitimacy that a clear picture of public action, or inaction, and decision making may emerge and making changes compatible with principles of administrative justice may be realized. This research with an analytical- descriptive method present a concrete approach compatible with all known mechanisms of administrative justice. Considering massive activities and interferences of state in all dimensions of public sphere, especially in countries such as Iran, establishment of an administrative justice system comprised of mechanisms of participation and redress is an undeniable necessity.
