Analyzing the Requirements of Legislation in the Rule of Plurality of Penal Crimes

Abstract

The goals of the law are unattainable by any rule and with any quality; therefore, observing criteria in legislation is necessary. In order to increase the quality, effectiveness, and efficiency of legal rules, the main goals of the legislator can also be realized. Based on this, paragraph 9 of the general legislative policies has established a set of criteria to determine the necessary policies in the legislative field for the approval of desired laws. By paying attention to these criteria, we can consider "transparency," "applicability," and "goal provision" among the basic benchmarks of ideal law.
Tracking the legislative process reveals the legislator's lack of attention to these criteria in some cases. One such case is the rule of material multiplicity of punishment crimes. Additionally, due to the intensified enforcement of plurality in crime cases and their connection to public order, compliance with these standards becomes even more important. Therefore, this research, using a descriptive-analytical method and library data, aims to answer the question of how the rule of plurality of discretionary crimes is evaluated concerning the requirements of "transparency," "applicability," and "goal provision." The results of this research indicate that these criteria have not been observed in many instances regarding the rule of plurality of discretionary crimes.
