Reviewing of the new legislation neccessity in terms of foreigners’ immobile property possession

Abstract

According to the decision of the general council of administrative justice court granting any privileges to foreigners such as possession of immobile property in the geographical territory strongly relies on the decision of the legislator. Then the above mentioned issue has a legislative nature.
Government’s authority in enforcing laws and approvals pertinent to foreigners’ immobile property possession in accordance with the law passed in the year 1963 and the note 7 of the article 148 editted in the year 1991 by the registration of deeds and land states act lacks legal legitimacy.
With regard to the legal vaccum following the invalidation of legal decision of the year 1963 of the board of ministers and foreigner acquistion  regulations which was defined in year 1949 by the board of ministers and cancellation, the way of non- residence foreigners acquisition of immobile property by general council of administrative justice court in year 1999 and to establish unified legal procedures in the  mentioned issue and to have transparent unity and to concentarte the scattered regulations and to resolve some ambiguities in foreigners acquisition, it is highly recommended to sumbit comprehensive legislation by authorities.
